5 Terms & Conditions of Use (TCU)

1 Purpose & Acceptance

These TCU govern the binding use of this Website and any service, product or legal relationship between the User and the Owner. By accessing or using the Site, the User confirms that they have read, understood and accepted these TCU.

3 Age Requirement

The Site and related Services are reserved for Users who are of legal age under applicable law.

4 Content & Intellectual Property

1. All content (texts, images, logos, videos, software, layout) is the property of the Owner or licensed to it.

2. Copying, modifying, distributing or exploiting content beyond normal Service use is prohibited without written permission.

3. Where indicated, Users may download or share content for personal, non‑commercial use, provided authorship and any other notices are respected.

5 Permitted Use

Users agree to:
• Use the Site in accordance with law, TCU and third‑party rights.
• Refrain from illegal, defamatory or harmful activities.
• Not upload viruses, malware or harmful code.
• Not interfere with security systems or Site functionality.
• Not reproduce or resell the Service without written consent.

The Owner may take any action (access block, authority reports, contract termination) to protect legitimate interests.

6 Access to Third‑Party Resources

The Site may contain links or integrations to external resources (websites, plugins, payment services). The Owner does not control and is not responsible for such content, availability or terms.

7 Sales Terms

7.1 Paid Products & Services

Reservations for umbrellas, loungers and ancillary services (“Products”) are paid as described on the Site; prices and availability may change without notice.

7.2 Booking Procedure

1. Select Product ➜ review summary ➜ confirm booking ➜ payment.

2. The contract is concluded upon receipt of the confirmation email; payment becomes due at that moment.

7.3 Prices & Payments

• All prices include taxes, bank fees and booking charges.
• If payment fails, the order will not be executed.

7.4 Cancellations, Refunds & “Rain Insurance”

*Example: stay starts 10 July → 100 % refund until 26 June 23:59; 50 % refund until 6 July 23:59.

Rain Insurance
Should the Beach Club remain closed the whole day due to bad weather, the unused day will be refunded. The insurance premium itself is refundable only if cancellation meets the above terms.

8 Liability Limitation

Within the limits of law, the Owner is not liable for bugs, viruses or other harmful elements transmitted through the Service, or for suspensions due to maintenance, force majeure or third‑party actions. Overall liability shall not exceed the amount paid by the User in the previous 12 months.

9 Indemnity

The User agrees to indemnify and hold harmless the Owner from claims, damages or expenses arising from misuse of the Site, violation of the TCU, third‑party rights or applicable law.

10 Privacy Policy

Personal data are processed according to the Privacy Notice published on the Site.

11 Service Modification or Interruption

The Owner may suspend the Service for maintenance or updates with appropriate notice, or discontinue it permanently, enabling Users to export their data where legally required.

12 Changes to the TCU

The Owner may modify these TCU at any time. Changes will be notified via the Site or email and will become binding on the date indicated. Continued use implies acceptance.

13 Governing Law & Jurisdiction

These TCU are governed by Italian law, without prejudice to higher consumer protection in the User’s country. Exclusive jurisdiction: Court of Trapani.

14 Out‑of‑Court Dispute Resolution

Users may send complaints to the Owner’s email; the Owner will reply within 21 days. EU Consumers may also use the EU ODR platform: ec.europa.eu/consumers/odr.

15 Key Definitions

• Owner / We: Conturrana S.r.l.
• User / You: any visitor or Site user.
• Consumer: natural person acting outside their professional activity.
• Product: good or service bookable/payable via the Site.
• Service: the functionalities provided by the Site.
